Secondary Legislation

Secondary legislation may be cited by number, short title, and OJ reference.

For regulations, the legislation number is followed by the year, e.g., Council Regulation 888/92/EEC on a Community ecolabel award scheme, OJ 1992 L99/1.

For directives and decisions, the year precedes the legislation number, e.g., Council Directive 90/314/EEC on package holidays, OJ 1990 L158/59.

Case Law

Since the establishment of the Court of First Instance, a letter prefix has been used to indicate which of the two Courts the case is before – C indicates the ECJ, and T the Court of First Instance. This is followed by the case number and the year in which it was lodged. There may be more than one number, as cases dealing with essentially the same point may be joined. The number is followed by the name of the parties and a reference to its publication in the European Court Reports (year, part, and page number; ECJ judgements appear in Part I, those of the Court of First Instance in Part II). Where a case has yet to be published the date of judgement is given. Thus, for example, Case C-415/93, Union Royale Belge des Sociétés de Football Association ASBL v Bosman [1995] ECR I-4921; Case T-105/95, WWF UK v Commission [1997] ECR II-313.

Appeals to the ECJ from the CFI are indicated by the letter P, e.g., Joined Cases C-174/98 P and C-198/98 P, Netherlands and van der Wal v Commission [2000] ECR I-0001.
